Terms & Conditions of Sales
Acheron Instrument provides these Terms and Conditions of Sale as the exclusive framework for managing the sales of any order placed at Acheron Instruments (the Product) by the purchasing entity (the Buyer).
The Products sold at Acheron Instruments are purchased and distributed exclusively to licensed healthcare providers, ensuring that these practitioners have the necessary skills to use Acheron Instruments products effectively. Moreover, the products are prescribed according to a specific criterion where the Buyer must possess a valid medical license to practice medicine in the jurisdiction where the Products will be applied.
Acheron Instruments’ acceptance of the Buyer’s order does not imply the acknowledgement of any type of printed terms and conditions provided by the Buyer on the order form or any other document delivered by them, which may differ or add to our Terms and Conditions. Any such additional or differing terms are simply rejected and considered void by us and are not considered, even with any given reason. Thus, the Buyers must agree to all the Terms and Conditions Acheron Instruments provides them. The Terms and Conditions can only be modified, altered, waived, amended, or superseded through an express written agreement issued by Acheron Instruments.
The Buyer's acceptance of the Products shows their understanding and confirms that they have reviewed and agreed to be bound by every provision of these Terms and Conditions of Sale. Consequently, accepting the Products will be regarded as conclusive evidence of the Buyer's complete and unreserved agreement to and acceptance of these Terms and Conditions.
Prices
The prices charged for all Products, including out-of-stock items, will be based on the prices effective on the day you place your order.
Acheron Instruments can change the prices of the Products without any prior notice. These changes may occur due to government price regulation, market conditions, or changes in any applicable laws or regulations that may affect the cost of production of the Products.
Requests for any kind of formal quotations should be sent to [email protected]. Moreover, all Quotations or inquiries are for immediate acceptance and are valid for thirty (30) days.
Terms of Trade
The Terms of Trade set the conditions of the sales agreement between Acheron Instruments and its Buyers. If your placed order is less than $5,000, then full (100%) advance payment is required. However, for larger orders exceeding $5,000, special payment terms can be negotiated and arranged in advance for significant purchases.
It is important to define certain Terms of Trade to clarify the responsibilities of the Seller and Buyer during the delivery process, including FOB, EXW, CNF, CIF, and DDP.
FOB (Free On Board) is the point or port of shipment where shipping costs and liability for the goods are transferred from the seller to the buyer.
EXW (Ex Work) is an international trade rule where the buyer is responsible for collecting the goods from the seller's premises or a specific location.
CNF (Cost and Freight) is a shipping agreement between the seller and the buyer, in which the seller is responsible for delivering the goods, with all shipping charges, to the specific port closest to the buyer.
CIF (Cost, Insurance, and Freight) is another shipping agreement in which the seller pays the cost, insurance, and freight of the buyer’s order to the named port of destination.
DDP (Delivered Duty Paid) is a delivery agreement in which the seller is responsible for safely transporting the goods to the desired location and covers all import duties, costs, risks, and taxes.
Duties & Taxes
Acheron Instruments is solely responsible and liable for origin-related duties and taxes applicable within Pakistani ports. Once the order is exported and delivered to international ports, all import-related charges, duties, and taxes shift entirely to the receiver/importers in the destination country. Thus, all value-added tax, customs fees, or tariffs by the manufacturing/importing country’s authorities at their ports are the direct obligation of the buyer.
Shipment of Products
Any loss, shortage, or damage to the shipped products must be reported immediately to the Acheron Instruments Customer Service Department within thirty (30) days of receiving the products, and the damaged order should be kept for inspection.
The delivery dates specified in the documents at order confirmation by Acheron Instruments are only tentative and not certain or fixed. There is a chance of delivery before or after the estimated dates.
The delay in delivery of the Products due to government regulations, delays in receipt of products from manufacturers or suppliers, tornados, floods, hurricanes, natural disasters, accidents, strikes, labor disputes, terrorist acts, war, embargoes, pandemics, or any other reason is not under the control of Acheron Instruments and we are not liable for it.
Acheron Instruments shall not be held responsible for any incidental, direct, indirect, consequential, or special damages experienced or caused by the Buyer. The special damages may involve changes or delays in delivery dates, partial deliveries, claims for lost profits, or untimely performance.
Product Replacement Policy
All requests for Product replacement must be submitted to the Customer Service Representative of Acheron Instruments, along with the date of purchase and invoices for easy processing.
Product replacement must be made within sixty (60) days from the invoice date. Furthermore, Acheron Instruments has the right to decline any replacement request submitted after this period.
The order must remain unopened, in its original packaging, and in a saleable condition for Product replacement.
Certain types of Products are not accepted for replacement by Acheron Instruments:

Products kept by Buyers for more than sixty (60) days.

Implant or sterile Products not in the original package
Warranty
The Acheron Instruments Warranty is not applicable to defective or damaged Products caused by abuse, normal wear and tear, misuse, negligence, accident, off-label use, or use beyond its limits.
The Warranty is applied to the following additional limitations:

Any repair, modification, or alteration made to Acheron Instruments' Products by parties other than them will void this warranty.

Warranty will be made against the LOT number of orders.

The springs on the Acheron Instruments Product are warranted against failure for three (3) years, under normal intended use.

All tungsten carbide instruments have a three-year warranty to maintain sharp edges under normal usage.

All non-tungsten carbide instruments come with a one-year sharpness warranty under normal usage.
Exclusive Remedy
Regarding any defects in workmanship or materials of the Products, the exclusive remedy is solely the choice of Acheron Instruments to repair or replace the defective product or credit your account. Furthermore, in no circumstances shall Acheron Instruments' liability exceed the lesser of : (1) the actual purchase amount the buyer paid to Acheron Instruments for the Products; or (2) Acheron Instruments' reasonable labor costs associated with the repair or replacement.
